Owen McDonagh, 31, of Big Isle, Manorcunningham, was judged not guilty by jury at Letterkenny Circuit Court after three-day trial

A jury has judged a man not guilty of assault in a 2022 Letterkenny incident after a three-day trial at Letterkenny Circuit Court.

The jury, made up of seven men and five women, found Owen McDonagh, 31, of Big Isle, Manorcunningham, not guilty of assault causing harm contrary to Section 3 of the Non-Fatal Offences Against the Person Act 1997.

McDonagh was accused that on December 28, 2022, at Cashel Park, Letterkenny, he allegedly assaulted Tom Ward, causing him harm.

Tom Ward gave evidence on the first day of the trial, firstly under questions from the Barrister for the State, Fiona Crawford BL, before he was cross-examined by the Defence Barrister, Brian McCartney SC.

The following day, Ward’s wife, Annie Ward, gave evidence before the defence team, called Owen McDonagh to give testimony, and his brother, Patrick McDonagh.

Ms Crawford and Mr McCartney both gave their final arguments to the jury on the third day, and Judge John Aylmer summarised the case to the jury before the Jury were sent to make their decision.

The jury deliberated for a period of 45 minutes before unanimously judging McDonagh to be not guilty of assault.
