Judge Éiteáin Cunningham said presence of children was an ‘aggravating factor’
Judge Éiteáin Cunningham ordered a Probation Report to be conducted after a man pleaded guilty to a burglary offence whilst being in the company of his two children at a Ballyshannon property.
Mykhailo Bruhosh, 22, of Marine View, Bundoran, pleaded guilty at Ballyshannon District Court, held at Ballyshannon Courthouse, to an offence on May 15, 2026, entering a building known as Woodlands Cottage, as a trespasser did commit an arrestable offence, to wit, the theft of items including a mobile phone, a watch, jewellery, and binoculars, contrary to Section 12(1)(b) and (3) of the Criminal Justice (Theft and Fraud Offences) Act 2001.
Gardaí apprehended Bruhosh after his children were seen exiting the property over a hedge.
Bruhosh was arrested on suspicion of burglary, a short distance away from the property, when he was taken to Ballyshannon Garda Station, and the items, listed to the value of €250, were discovered on the defendant.
The defendant’s solicitor, Gerry McGovern, said: “My client has pleaded guilty
“My instructions were that he cooperated fully with the Gardaí. He has been living in Ireland for four years and has two children.”
Judge Cunningham said: “It is very serious. One is the breaking-in into someone else’s dwelling. One’s dwelling should be a place of sanctuary.
“Of most concern is the involvement of two children. That is absolutely aggravating. I accept that the accused has entered a plea at the earliest opportunity. I have taken into account that he has no previous convictions, but given the nature, I am going to direct a probation report.
McGovern informed the court that Bruhosh was a Ukrainian national and had limited English. An application was also made for legal aid.
The case was adjourned until September 18.
