A Glencolmcille man has appeared in court following an alleged serious assault on Sunday evening.
Adam McIntyre, a 29-year-old with an address in Glencolmcille, was before Wednesday’s sitting of Glenties, after being charged with assault causing harm and possession of knives.
McIntyre is charged with assaulting Darragh O’Gara causing him harm, an offence contrary to Section 3 of the Non-Fatal Offences Against The Person Act 1997 at Cashel, Glencolmcille on April 24, 2023.
He is also charged that, on the same date at Cashel, Glencolmcille, he had a knife with a blade which was sharply pointed, contrary to Section 9 (1) and (7) of the Firearms and Offensive Weapons Act, 1990 as amended by Section 39 of the Criminal Justice (Miscellaneous Provisions) Act, 2009.
Mcintyre is also charged that on April 24 at Ascal Mhuire, Glencolmcille, he had a ‘Morakniv’ black-handled knife and a ‘Victorinox’ black-handled knife, which had a blade which was sharply pointed, under the same Act.
Detective Garda Patrick Kelly of Ballyshannon Garda Station told the court that he arrested the defendant at 9.19 pm at Portnason, Ballyshannon on April 25. McIntyre was charged at 9.36pm on the same date.
The accused made no reply to the charge, the court heard.
Detective Garda Kelly said there was no objection to bail, provided that certain conditions were imposed.
The defendant is not to have either direct or indirect contact with the alleged victim or any witnesses; he is not to commit any further offences while on bail; he must sign on at Ballyshannon Garda Station every Monday, Wednesday and Friday; he must reside at an address in Glencolmcille; is to maintain a curfew from 10pm to 7am; and has had to surrender his passport to Gardai.
Defence solicitor Maureen Gallagher said the accused’s passport could be handed in within 24 hours.
The court heard the defendant’s mobile phone had been seized but he would try and get another number for Gardai as soon as possible.
Inspector Seamus McGonigle asked for the case to be put back to July 26 to Glenties District Court for directions from the Director of Public Prosecutions (DPP).
Ms Gallagher applied for legal aid and a psychological assessment of her client.
The dark-haired, bearded defendant, who was wearing a light blue T-shirt and black tracksuit trousers, did not speak during the hearing.
Judge Éiteáin Cunningham remanded the defendant on his own bond of €200 to appear again on July 26.
