A 50-year-old man has been disqualified from holding a licence for two years for driving a Transit van while exceeding the legal alcohol limit.
Cathal Devenney, of 28 O’Kane Park, Omagh was also fined €250 at Ballyshannon District Court on Monday.
He pleaded guilty to driving while exceeding the legal alcohol limit at Single Street, Bundoran on March 16, 2022.
Inspector Angela Cummins told the court that garda attention was drawn to the van due to the manner of driving. Devenney was arrested and brought to Ballyshannon Garda Station where he was found to have an alcohol level of 199mg per 100ml of urine.
Solicitor Rory O’Brien said his client suffered from a longstanding disability and addiction to alcohol.
“He had been sober for a period of time and unfortunately slipped,” said Mr O’Brien, adding that the defendant was engaging with various services and fully accepted the consequences.
Judge Patricia Cronin noted that Devenney had no previous convictions and had pleaded guilty. However, she said that she had no discretion with regard to the two-year disqualification.
