Man to face trial for dangerous driving causing death of Killybegs woman

A 51-year-old man replied ‘not guilty’ to a charge of driving in a manner that was dangerous to the public, thereby causing the death of Eileen Kennedy. 

The alleged offence took place at Corporation, Killybegs on January 10, 2023.

Emmet McCormack of Dooish, Ballybofey was before Donegal District Court on Monday. 

Sergeant Ciaran McDermott gave evidence of arresting the defendant ahead of the court sitting. He said that when cautioned, McCormack replied ‘not guilty’.

Inspector Angela Cummins told the court that the Director of Public Prosecutions (DPP) directed for the matter to proceed on indictment to the circuit court on one count of dangerous driving causing death. 

She added that there was consent to the accused being sent forward for sentence on assigned plea should this arise. 

Sgt McDermott asked that bail conditions be imposed as follows: that the defendant signs on once a week at Donegal Town Garda Station; that he refrains from contacting any witnesses in the case; and that he refrains from speaking to any witnesses about the case, including work colleagues. 

Judge Ciaran Liddy adjourned the matter to June 24 for service of the book of evidence. He granted legal aid in respect of solicitor Margaret Mulrine and one junior counsel.
