A 51-year-old man has been sent forward for trial at the circuit court on a charge of driving in a manner that was dangerous to the public, thereby causing the death of Eileen Kennedy.
The alleged offence took place at Corporation, Killybegs on January 10, 2023.
Emmet McCormack of Dooish, Ballybofey was served with the book of evidence ahead of Monday’s sitting of Donegal District Court on Monday. A previous court sitting heard that when cautioned, McCormack replied ‘not guilty’.
Inspector Angela Cummins told the court that the Director of Public Prosecutions (DPP) consented that the accused be sent forward for trial on the single charge as outlined in the book of evidence.
Judge Michael Connellan remanded the defendant on continuing bail to appear before the next sitting of Donegal Circuit Court beginning on November 12.
Bail conditions are that the defendant signs on once a week at Donegal Town Garda Station; that he refrains from contacting any witnesses in the case; and that he refrains from speaking to any witnesses about the case, including work colleagues.
The court heard that legal aid had already been granted to solicitor Margaret Mulrine and one barrister.
