A book of evidence has been served in relation to charges of harassment allegedly carried out by a member of An Garda Síochana.
Patrick Hugh Maguire of Rock Road, Bundoran has been sent forward for trial on two charges in a case taken by the Garda Ombudsman.
It is alleged that on dates between April 4, 2020 and March 31, 2022 inclusive, at Rock Road, Ballyshannon, that without lawful authority of reasonable excuse, he harassed Brendan Mitchell by any means including persistently besetting and communicating with him.
A charge for the same offence applies in relation to Michele Louise Mitchell.
At Ballyshannon District Court on Friday, September 6, a representative of the office of the Garda Síochána Ombudsman Commission gave evidence of serving Maguire with the book of evidence.
State solicitor Kieran Dillon told the court that the Director of Public Prosecutions (DPP) consented to the defendant being sent forward on indictment for trial at the circuit court.
“She also consents for him to be sent forward for sentence on an assigned plea should that arise,” added Mr Dillon.
Judge Sandra Murphy sent the defendant forward for trial to the next sitting of Donegal Circuit Court, sitting in Letterkenny and commencing on December 12.
Bail conditions are that Maguire have no contact directly or indirectly, including via social media, with the alleged injured parties.
