Central Criminal Court
A man with an address in south Donegal is to face trial in the Central Criminal Court for the alleged rape of a female.
The defendant cannot be named in order to protect the identity of the alleged victim.
It is alleged that he raped the female at an address in south Donegal in December 2020.
The offence is contrary to Section 48 Offences Against the Person Act 1861 and Section 2 of the Criminal Law (Rape) Act, 1981 as amended by section 21 of the Criminal Way (Rape) (Amendement) Act, 1990.
The defendant was served with the book of evidence ahead of his appearance at a recent court sitting in south Donegal.
The court heard that the Director of Public Prosecutions consented for the defendant to be sent forward for trial to the Central Criminal Court, sitting in Dublin, with the date to be advised.
Judge Sandra Murphy sent the defendant forward on continuing bail.
Bail conditions include: that the defendant sign on two times per week at a nominated garda station; that he have no direct or indirect contact with witnesses or alleged victim; that he surrenders his passport; and that he resides at a given address and be available on a mobile phone number given to gardaí 24/7.
