A woman has been warned that she cannot continue to breach an order whereby her three adult sons are barred from visiting her home.
Anne Ward, of 15 Armada Cottages, Bundoran was before Ballyshannon District Court on Friday, December 20. The court heard that she had breached a barring order which forbids her adult children from visiting the property.
The order is related to ongoing legal proceedings involving property owners Donegal County Council, and neighbouring tenants who have allegedly been subjected to prolonged anti-social behaviour.”
Her daughters are permitted to attend if medical assistance is required.
An emotional Ward told the court: “It’s very hard for me if my sons want to come and visit their mother. I’m all they have.”
Judge Sandra Murphy told Ward: “I am hearing from you that you are not fully prepared to comply with that undertaking.
“It is very clear to me that nobody is allowed into that property except your daughters in the event of a medical emergency. That is not happening.
“The situation is intolerable for your neighbours.
“There is no need to have your children there between those hours.”
Ward replied: “From today on it will be followed.”
The judge warned her: “If it is not, I won’t have a choice but to send you to prison.
“You gave the undertaking twice before. “I should have you arrested today and taken off to prison. I don’t want to do that. But the situation is intolerable.
Ward promised that she would phone the gardaí if any of those who were barred came to her door.
“I give my word,” she said.
Solicitor for Donegal County Council Kevin McElhinney pointed out: “Mrs Ward you have never called the guards.”
Judge Murphy reminded the defendant that she had given the undertaking under oath.
The judge granted liberty to re-enter the matter at short notice.
“The main matter is in for hearing in March, so I will adjourn to the special sitting in Donegal Town in March.
“If you breach the undertaking, the next judge will have no option but to send you to prison.
“If there is any breach, the guards can re-enter the matter or the council can re-enter the matter.”
