Donegal man, 70s, faces rape trial at Central Criminal Court

The man was served with a book of evidence recently

A Donegal man accused of rape has been sent forward to the Central Criminal Court for trial.

The man appeared at a sitting of Falcarragh District Court recently and was served with a book of evidence in the case.

The man, who is in his 70s, was accompanied to court by members of his family.

He is charged that on an unknown date between May 7, 1972 and September 1, 1973  at a location on Donegal, he did rape a female.

The charge is contrary to section 48 Offences Against the Person Act, 1861 and section 2 of the Criminal Law (Rape) Act, 1981 as amended by section 21 of the Criminal Law (Rape) (Amendment) Act, 1990

Garda Sergeant Jim Collins told the court that the Director of Public Prosecutions (DPP) has consented for the man to go forward for trial at the Central Criminal Court on one charge.

Judge Emile Daly gave the accused the alibi warning.

The accused man's solicitor, Mr Patsy Gallagher, requested both a senior and junior counsel "given the severity of the charges."

The man was released on bail to the next sitting of the Central Criminal Court.
