Donegal Judge says she will ‘absolutely not’ reduce dangerous driving charge

The defendant was before Ballyshannon District Court for speeding in Ballintra

A district court judge said would absolutely not reduce a charge of dangerous driving to careless driving, after hearing the speed at which the defendant was travelling.

Dylan Leonard, 34, of 205 Pettigo Road, Kesh was before Ballyshannon District Court on Friday, January 16. He is charged with dangerous driving at Ballymagroarty Irish, Ballintra on December 27, 2025. The offence is contrary to Section 53(1) of the Road Traffic Act, 1961 as substituted by Section 4 of the Road Traffic (No 2) Act 2011.

Solicitor Francis Gillespie asked the court to consider reducing the charger to one of careless driving. Unlike dangerous driving, the lesser offence of careless driving does not carry an automatic disqualification.

On hearing that the defendant had been travelling at 160km/h in a 100km/h zone, Judge Éiteáin Cunningham said: “Absolutely not. I am not prepared to do that.”

The case was adjourned to January 26 to fix a date for hearing.
