Submissions in a legal case being taken by Donegal County Council against former waste operator Jim Ferry are due to be lodged next month.
The matter was briefly mentioned at Falcarragh District Court.
The case relates to an enforcement notice, dated March 15, 2022 that was served on Ferry in accordance with the Planning and Development Act, 2000.
The enforcement notice relates to an unauthorised development at Rossbracken, Manorcunningham and Ferry is accused that he did not take the steps required, an offence contrary to the form of section 154 (8) and 156 of the Act.
Originally, the submissions from Ferry’s legal team were to be with the court by January 14 and the reply of Donegal County Council was due to have been lodged by January 20.
Ferry was not present in court, but was represented by barrister Mr Alexander Smyth BL.
Ms Donna Ferry, solicitor for Donegal County Council, told the court that she received submissions on behalf of Ferry on the morning of the court sitting.
The court was informed that the matter would have to go back and the case was adjourned until the February 18 sitting of Falcarragh District Court.
Judge Emile Daly told the parties that it would be in ease of the court if the submissions could be filed within three weeks.
