The defendant (34) has been fined for riding his motorcycle without insurance in Inishowen.
A Buncrana-based chef who drove a motorbike without insurance has avoided a driving ban but was fined €400 when he appeared before Buncrana District Court.
Jamie Schaufler, of 28 Carraig Fern, Buncrana, pleaded guilty to a charge of having no insurance in relation to an incident last year.
The 34-year-old is originally from Australia but is now living in Inishowen, the court heard.
The facts of the case were presented by Sergeant Conor Mulkerns. He explained how on Thursday, April 24, 2025, at approximately 3.30pm, gardaí were on mobile patrol in the Tullyaravan area of Buncrana when they observed a grey Kawasaki 600 motorbike being driven past.
Checks carried out on the Garda mobility device indicated that there was no active insurance policy in place for the vehicle.
The motorcyclist, later identified as Mr Schaufler, was stopped and a lawful requirement was made for him to produce proof of insurance at a Garda station of his choosing within ten days. However, no documentation was subsequently produced.
Mr Schaufler has no previous convictions.
Defence solicitor Frank Dorrian told the court that his client’s failure to have valid insurance was the result of an administrative oversight rather than any deliberate wrongdoing.
He explained that Mr Schaufler had previously been insured while driving on a learner permit.
When he later obtained a full driving licence, he contacted his insurance company to update his details and arrange a renewal of his policy. While the terms and cost of the policy had been agreed, Mr Schaufler ultimately failed to pay the premium.
Mr Dorrian described the situation as “completely self-inflicted” and accepted that it was entirely his client’s responsibility.
He added that Mr Schaufler works as a chef, earning approximately €500 per week, and is the father of one child. He asked the court to consider not imposing a disqualification, noting that his client relies on his licence.
Judge Emile Daly said that while she would not impose a driving ban for a first offence of this nature, a conviction was warranted. She also imposed a fine of €400.
Legal aid was granted to Mr Dorrian in the case.
