Bench warrant executed on man at Ballyshannon Courthouse

A man recently granted bail at Donegal District Court while facing 21 charges was remanded in custody after a bench warrant was executed against him for a theft offence at Dublin Airport.

Krsyztof Siergiej, 39, of no fixed abode, but having had addresses in Donegal Town and Bundoran, had failed to appear at a District Court sitting in Dublin for an alleged offence in July.

Judge Éiteáin Cunningham was told by Gardaí at Ballyshannon Courthouse that they consented to his bail, but Siergiej said he could not provide the €200 bond at the time of the court’s sitting.

He was arrested and charged that on July 3, 2026, at Insomnia, Arrivals Hall, Terminal One, Dublin, he did steal property, to wit, a bottle of beer to the value of €2.75, the property of Insomnia Coffee Ireland, contrary to Section 4 of the Criminal Justice (Theft and Fraud Offences) Act 2001.

Siergiej also appeared before an additional charge, that on September 12, 2026, at Main Street, Donegal Town, he was present in said public place while intoxicated to such an extent as would give rise to a reasonable apprehension that he might endanger himself or any other person in his vicinity, contrary to Section 4 of the Criminal Justice (Public Order) Act, 1994, as amended by Section 22 of the Intoxicating Liquor Act 2008.

Garda Sergeant Oliver Devaney told the court: “In respect of the new charge, I am in a position to consent to bail on a cash lodgement with conditions.” He added that Siergiej was to remain sober, reside in Donegal Town, sign on twice weekly at a Garda Station and a cash lodgement of €200 “based on his history of non-appearance.”

About the Dublin charge, Gda Sgt Devaney said: “The warrant is in effect, a Dublin matter, and I am in a position to deal with that. It is a relatively minor charge. It can adjourn until Monday, September 21.

“I suggest that the local matter be adjourned to Friday, September 18, in Ballyshannon.”

A Gardaí officer, acting as an interpreter for Siergiej, said: “He says that he doesn’t have the money at the moment.

“I have outlined the conditions to him. His response is that he doesn’t have the money. He would have the money next week, and he doesn’t have a phone at the moment.”

Judge Cunningham asked if Siergiej could be assisted with making a phone call, to which Gda Sgt Devaney responded positively.

After the second call, Sgt Gda Devaney told Judge Cunningham: “Unfortunately, despite making a number of phone calls, he has not been in a position to raise the money.”

Judge Cunningham explained that the only order she could make was to remand Siergiej in custody with consent to bail; once he could come up with the money, he could be released at that time.

She asked if there was a reality with Siergiej coming up with the bail money by Friday, September 18, to which his interpreter replied: “He says he will try his best.”

Gda Sgt Devaney said they would make “enquiries with some of his friends in Donegal Town.”
