The Director of Public Prosecutions (DPP) will consider putting a Newtowncunningham, who is charged with assault causing harm and interfering with a witness, on trial.
At Letterkenny District Court this week, Judge Éiteáin Cunningham refused jurisdiction in the case of Scott Magee.
The accused, a 25-year-old from Coill na Ros Newtowncunningham, is charged with assault causing harm to a man at Ramelton Road, Letterkenny, on December 4, 2021.
The offence is contrary to Section 3 of the Non-Fatal Offences Against The Person Act, 1997.
Magee is further charged that on February 13, 2022 he did harm, threaten, menace, intimidate or put in fear another person who was assisting in the investigation by An Garda Siochana of an offence or is witness/potential witness/juror/potential juror in proceedings with the intention of causing the investigation/the course of justice to be obstructed, perverted or interfered with.
The offence is contrary to Section 41 (1) and (5) of the Criminal Justice Act, 1999.
Judge Cunningham told the court that she was refusing jurisdiction in the matter.
The case was adjourned to March 27 next.
