Planning permission for the housing development at Tievebane, Burnfoot was first granted in 2005

Rockstown Developments Limited has resubmitted a planning application to demolish five partially-built homes and rebuild them in Burnfoot, twenty years after planning permission was initially granted to construct them.

Rockstown Developments Limited is seeking the demolition of the blockwork of five partially completed houses and to rebuild the five properties at Rockstown in Tievebane. 

The site is currently occupied by a house and five other partially constructed homes. The development of six detached houses was first granted planning permission by the Council in August 2005 to Gregory McElhinney.

A further application for an extra dormer-style house was granted permission a year later in 2006, and Rockstown Developments was also granted two extensions of duration of five years in 2010 for both applications.

In 2022, an application was submitted to the planning authority for the completion of multiple homes in the estate, after the time had lapsed on the previous application. 

Donegal County Council decided to grant planning permission three years ago for the completion of the multiple residential development, but this was appealed to An Coimisiún Pleanála and subsequently overturned at the start of last year.

The planning body refused permission for several reasons. These included concerns about the wastewater treatment system and the disposal of surface water at the site.  

An Coimisiún Pleanálaalso outlined how, following the information that was provided with the application and submitted in the objector's appeal, in the absence of a Natura Impact Statement, the Board wasn’t satisfied to grant permission.

In the current planning application, Rockstown Developments outlined that a Natura Impact Statement is included in the application.

A decision on the planning application is expected to be made on the 24th of November.

A previous application in respect of the same site was made in June but was withdrawn on 9th September of this year.
