A 20-year-old man who admitted driving without insurance was ‘inattentive’ rather than intentionally committing a crime, Dungloe District Court heard.
Dylan Hegarty of 6 Abbey Village, Kilmacrennan, appeared before Judge Emile Daly at the February sitting of An Clochan Liath / Dungloe District Court. He admitted driving without insurance at Meenderrygamph, Gweedore on March 24, 2025.
Solicitor Frank Dorrian told the court that his client received a notification from the insurance company that his policy had been cancelled due to a missed payment.
“He didn't become aware of that until after this took place,” said the solicitor.
“It was inattentive but he was unaware that he did not have insurance in place.
“He has no previous convictions. He seems to have tripped over this, and has otherwise good character.”
The solicitor told the court that Hegarty was in receipt of Disability Allowance.
“My application is for him not to be disqualified,” said Mr Dorrian. “Mobility is central to his living in this area and his disability is such that it would be a requirement to drive.”
Judge Daly replied: “In light of the plea entered at an early stage, and as a result of his disability and his needs to be mobile, I am not going to disqualify him.”
The judge imposed a conviction and fine of €350
