The matter came before Letterkenny District Court with Donegal County Council highlighting a planned ‘diffing’ event at the site of a former waste disposal plant

Enforcement order served on former waste operator

An enforcement notice has been served on a former waste operator in Donegal.

Letterkenny District Court heard this week that the notice was served on James (Jim) Ferry, on December 7 last by registered post.

The notice relates to an unauthorised development at Rossbracken, Manorcunningham.

Solicitor for Donegal County Council, Mr Kevin McElhinney, said the matter related to a change of use to a waste disposal facility.

Mr McElhinney said the facility in question is to be used as a car diffing facility.

“In the event that a diffing event proceeds as advertised, we will ask the court to take a view,” he said.

Ferry, of Slieve Sneacht, Glencar, Letterkenny, was represented in court by solicitor Ms Maureen Gallagher, on behalf of JV Geary Solicitors, Castlebar.

The court was told that the matter is open to a full contest.

Judge Éiteáin Cunningham said she would make a note regarding the advertised car diffing event and adjourned the matter until May.
