A 76-year-old woman has been convicted of careless driving for colliding with a parked car.
But she will not face a disqualification after the court agreed to reduce the charge from one of dangerous driving which would have carried an automatic ban.
Anne Hunter of 6 Oakfield Manor, Kinlough, Leitrim was before Ballyshannon District Court on Monday. She pleaded guilty to the offence which took place at Main Street, Kinlough on July 17, 2022.
Inspector Angela Cummins told the court that at 8pm on the date in question, gardaí responded to a report of material damage.
“The vehicle driven by the defendant had collided with a parked car.
“She admitted the offence.”
Solicitor John Anderson told the court that the matter had been dealt with by his client’s insurance company. He asked Judge Patricia Cronin to accept a plea to the lesser charge of careless driving.
“It would have been her son’s anniversary,” said Mr Anderson. “He had died the year before from Covid. It was playing heavily on her mind.
“She has osteoarthritis and uses a stick. Her licence is important to her for her mobility.”
Judge Cronin agreed to reduce the charge, saying no evidence had been put forward that would have met the threshold for a dangerous driving charge.
In considering whether to impose a driving ban for careless driving, the judge said: ““I am noting the personal circumstances of Mrs Hunt. It was around the time of her son’s anniversary. The court extends sympathy to Mrs Hunt on the loss of her son.
“She is a lady driving for a considerable period of time with no issues.
“She has medical issues and her licence is very important to her.
“The court is going to exercise discretion and not disqualify for careless driving.”
The judge did however impose a conviction and a fine of €150.
On behalf of his client, Mr Anderson said: “Thank you Judge, she is most grateful.”
