A 23-year-old man has been sent forward for trial for allegedly producing an assault article capable of inflicting serious injury.
Mark O’Connor, whose address was listed as ‘no fixed abode’ was before Donegal District Court where he was served with the book of evidence by Garda Brendan Waters.
O’Connor is charged that on December 15, 2023 at Apt 64 Railway Park, Drumrooske, Donegal Town, he allegedly, while committing an offence contrary to Section 3 of the Non Fatal Offences against the person act 1997, produce an assault article capable of inflicting serious injury to wit, blue candle. The offence is contrary to Section 11 Firearms and Offensive Weapons Act, 1990.
It is also alleged that he assaulted Leo Forde causing him harm on the occasion. That offence is contrary to Section 3(1) and 3(2) of the Non-fatal Offences against the Person Act 1997 (as amended by Section 20 of the Criminal Justice (Miscellaneous Provisions Act 2023).
Inspector Aoife Curley told the court that the Director of Public Prosecutions (DPP) consented to the accused being sent forward for trial at the circuit court.
Judge Sandra Murphy sent the defendant forward on bail to Donegal Circuit Criminal Court sitting in Letterkenny, commencing December 9.
Legal aid was granted to solicitor Kieran O’Gorman and one junior counsel.
