Forty-nine housing estates in Donegal exempt from Property Tax

Forty-nine ‘ghost’ estates in Donegal are among 1,770 across the country which will be exempt from the new Local Property Tax.

The Dept. of the Environment has today published a list of all the unfinished estates where owners will not be liable for the tax, and released details of a waiver which will apply.

Most of these estates are also on the Department’s list of those exempt from the Household Charge. There are 101 such housing estates in Donegal, and 1,322 across the country.

The new Local Property Tax is due to come into effect from the second half of the year.

The deadline for paper returns is 7 May, while online returns can be made until 28 May.

The tax is calculated on the value of the property and is self-assessed by the owner.

Minister for the Environment Phil Hogan commented: “It is right and proper that households in unfinished developments should be exempt from payment of the Local Property Tax. The number of properties eligible for a waiver reflects the progress made in tackling unfinished housing developments, as well as the more objective approach to categorisation applied to the 2012 National Housing Development Survey.

“I would urge people not to assume that just because they were eligible for a waiver from the household charge they will be eligible for an exemption from the local property tax. The list has changed substantially, reflecting the improvements made by local authorities in resolving problems in unfinished housing developments. There is plenty of information out there. People can contact their local authority or check the local authority website for the list of developments to which the exemption.”

What is an Unfinished Housing Estate Waiver?

The legislation provides that an owner of residential property which is situated in an unfinished estate, within the meaning contained in the Local Government (Household Charges) Act 2011, on the liability date (1 January 2012) is entitled to a waiver from payment of the Household Charge in respect of that property for that year.

A national survey of unfinished housing developments was carried out in 2011 by officials from the Department of the Environment, Community and Local Government, in conjunction with the Planning Departments of the various local authorities. As part of this survey, all unfinished developments were examined and categorised along the following lines:

Category 1: the development is still being actively completed by the developer;

Category 2: a receiver has been appointed;

Category 3: a receiver has not been appointed and the developer is still in place but effectively inactive; and

Category 4: the development has been effectively abandoned and is posing serious problems for residents.

Only categories 3 and 4 unfinished housing estates qualify for the waiver.

A person who, on 1 January 2012, is an owner of a residential property in an unfinished development contained in the prescribed list is entitled to claim a waiver from payment of the Household Charge in 2012. This prescribed list consists only of developments under Categories 3 and 4. Persons claiming entitlement to a waiver must complete the Household Charge registration form.
