A District Court Judge has sought a victim impact statement from a man whose father produced an axe during the course of a dispute in Letterkenny.
Milan Horvat is before Letterkenny District Court in connection with an incident at Parkview Drive, Letterkenny, on August 10, 2022.
Horvat, a 65-year-old of Parkview Drive, is charged that he did, in the course of a dispute, produce in a manner likely unlawfully to intimidate another person, an article capable of inflicting serious injury, to wit, an axe.
The offence is contrary to section 11 of the Firearms and Offensive Weapons Act, 1990.
Solicitor for Horvat, Mr Patsy Gallagher, told the court that the alleged injured party in the case is the defendant's son.
“There is a plea to having the axe,” Mr Gallagher said. “It was there in his hands and there was a dispute. It wasn't used for anything.”
Judge Éiteáin Cunningham put the matter back to April 17, 2023, and directed that a probation and welfare report be prepared.
Sergeant Gerard Dalton said that the view of the injured party in the case would be canvassed via a victim impact statement.
