European ruling favours Donegal fishermen

The Killybegs Fisherman’s Organisation (KFO) has welcomed the ruling by the European Court of Justice against a EU commission decision not to grant Irish fishermen extra tonnage on the basis of expenditure on safety measures in 2001.

The Killybegs Fisherman’s Organisation (KFO) has welcomed the ruling by the European Court of Justice against a EU commission decision not to grant Irish fishermen extra tonnage on the basis of expenditure on safety measures in 2001.

The 11 fishermen, most of them based in Donegal, have secured the second such decision against the European Commission.

The KFO said the court ruling very clearly states that the Commission did not have the powers to make the decisions and the applicants had the right to bring an action for damages.

CEO of the KFO Sean O’Donoghue called on the Commission to sit down with the applicants to resolve the long outstanding issue.

“I am delighted but not surprised that the European Court has ruled for a second time in their favour and annulled the 11 Commission decisions.”
